Terms and Conditions

AGREEMENT
The terms and conditions of this document together with the completed Booking Form for your stay comprise your agreement between the owners of The Mountain Whisper Chalet and all those listed on the Booking Form. No contract exists until payment of deposit is received and processed and a confirmation of booking has been sent.

BOOKING
Once availability has been confirmed, a deposit of 30% of the total amount becomes payable prior to the acceptance of the booking and the inception of the Booking Contract. The total amount outstanding must then be paid in full, 10 weeks prior to the date of arrival. If the booking is made less than 10 weeks prior to the date of arrival, then the full amount is due at the time of booking.

It is your responsibility to read your letter of confirmation carefully and inform us of any mistakes or discrepancies. If you decide to change your flight and wish to change your booking we will do our very best to accommodate the change but we cannot guarantee that we will be able to do so.

The group leader is fully responsible for himself / herself and all other members of the group for all matters relating to the booking, thus he/she will be personally responsible for all monies outstanding from the members listed on the Booking Form. If there is for any reason a change to the group leader or a change in the party members, we must be notified straight away and a new Booking Form must be signed.

PRICE
The weekly price quoted is for 7 nights accommodation and for the exclusive use of the entire chalet and all the facilities on a Self Catered Basis and includes the end of stay cleaning. The price does not include Airport Transfers, Catering Services, Flights or Travel Costs, Insurance, Lift Passes, Equipment Hire or Lessons and Childcare. At the time of printing our prices are true and correct, however we do reserve the right to increase or decrease the prices at any time but we do guarantee the price quoted at the time of booking.

Credit Card details will be taken on arrival as a security deposit against Damage to the Property and any Loss or Breakages.

PAYMENT
An email will be sent to you 12 weeks prior to your arrival date showing you the due balance. This must be paid no less than 10 weeks prior to your arrival date. If the final balance is not received within 10 weeks of your arrival date, we reserve the right to cancel the booking and any deposits paid will be forfeited.

We will make every effort to contact you within this period but if payment is not made we reserve the right to re-book the chalet without further notice. In the event of a dishonoured payment the group leader will be contacted and asked to make the payment by other means, failure to do this will resort in the booking being cancelled.

CANCELLATION BY US THE OWNERS
We reserve the right to amend or cancel a booking entirely and refund all monies paid. In the unlikely event that WE need to amend or cancel a booking, we will contact the group leader immediately and will offer alternative dates for the same value for accommodation if available or offer a full refund. We accept no legal liability of any costs incurred with parties other than ourselves and will pay no other compensation. No form of compensation or refund will be paid if a cancellation is caused by events amounting to Force Majeure such as warfare, riots, civil unrest, terrorist activity, industrial dispute, weather, lack of snow, road closures, including access roads to Morzine, epidemics, natural or technical disasters, nuclear war or similar events out of our control.

CANCELLATION BY YOU THE CUSTOMER
You or any member of your party may cancel your holiday at any time providing that the group leader makes the cancellation in writing/email. We accept no responsibility for non-delivery or non-receipt of the written cancellation. The date of the cancellation will be the date that we receive the cancellation letter. Your deposit will be retained and cancellation charges levied as follows:

  • 10 to 6 weeks before commencement of holiday : 50% of total holiday cost

  • 6 to 4 weeks before commencement of holiday: 75% of total holiday cost

  • 4 or less weeks before commencement of holiday: 100% of total holiday cost

INSURANCE
It is a condition of booking that all occupants are covered by their own comprehensive travel insurance during their stay.

LIMITATION OF LIABILITY
We do not accept any liability for or pay compensation for:

  • Any event or circumstance that could not be foreseen or avoided, amounting to Force Majeure such as warfare, riots, civil unrest, terrorist activity, industrial dispute, weather, lack of snow, road closures, including access roads to Morzine, epidemics, natural or technical disasters, nuclear war or similar events out of our control.

  • Any loss or damage to property / personal effects suffered by you the customer, during your stay.

  • Any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, machinery or appliance in the property or garden.

  • Any cancellation, loss, delay or costs arising from or connected with adverse weather conditions, avalanche, land slides, snow conditions and the affect these have on the travel arrangements, accommodation or activities.

  • Any limitations imposed by the resort authorities, ski-lifts, the ski schools or the ski hire operator.

  • Any loss or damage or inconvenience caused to the customer if the chalet is damaged or destroyed before the start of the holiday, in such an event we will endeavour to refund all sums previously paid in respect of the holiday.

  • Any personal injury or death to the customer during the duration of stay.

  • Our liability to the customer will never exceed the amount paid by the customer for their holiday.

BEHAVIOUR AND RESPONSIBILITIES
All guests should act in a manner as to not cause offence to other guests in the chalet, the neighbours or the local residents or have a negative effect on the reputation of the management company – Treeline Chalets. This includes excessive noise within the chalet. All guests must not threaten the condition of the chalet. The chalet must be left in the same condition as it was at the start of your holiday. Treeline Chalets on behalf of the owners reserve the right to recover from the customers the cost of breakages and damage to the property caused with or without intent by the customers. No illegal activities or substances are permitted on the premises and the chalet operates on a strict no smoking policy.

The property is rented as Self Catered, however if you wish to order catering during your stay, we have recommended some reputable catering companies, but all outside catering services and staff are the sole responsibility of you the customer and hence liable for any loss or damage caused to the property during their presence.

In the event of any infringement on these expectations, the management company on behalf of the owners, reserve the right to terminate the contract with immediate effect and demand you vacate the property.
